Terms and Conditions for The Racquets Club 'Roger Federer Racket Giveaway on Instagram'
These terms and conditions apply to the online promotion "The Racquets Club CL Roger Federer Racket Giveaway". The competition runs from December 16th to December 30th, 2024.
The Promoter is The Racquets Club LMC SL, with registered office at centro de tenis, la manga club, 30383 Cartagena, Murcia, Spain.
1. Eligibility The promotion is open to residents of the EU aged 18 or over, excluding employees of the Promoter, their immediate families, its agents, or anyone professionally connected with the promotion.
2. Acceptance of Terms By entering the promotion, entrants confirm that they have read and agree to be bound by these terms and conditions and by the decisions of the Promoter, which are final in all matters relating to the promotion. Failure to comply will result in the forfeiture of the prize. No correspondence will be entered into.

Participants can enter multiple times by tagging more friends each comment counts as a new entry.
4. Entry Requirements Only entries received by the Promoter within the designated entry period will be considered. Any attempted form of entry other than as described in these Terms and Conditions is void. Entry must be made by one individual entrant; no group or organisation entries will be accepted.
The entrant’s Instagram profile will be used to contact them for any prizes, so please ensure this information is accurate.
5. Prize Participants have the chance to win one (1) limited edition Wilson Pro Staff RF97 Roger Federer tennis racket. The prize is non-refundable, and no cash alternative is available. The prize must be taken as stated, and no compensation will be payable if a winner is unable to use the prize as stated. The Promoter reserves the right to provide an alternative prize of equal value if, due to circumstances beyond its control, the stated prize is no longer available.
The prize can be collected in person at The Racquets Club or sent via courier to addresses within Europe only. Delivery times are dependent on the courier, and The Promoter is not responsible for any delays caused by courier services.
6. Winner Selection The winner will be selected at random from all valid entries. The draw will be conducted on December 30th, 2024, and the winner will be informed by midnight on that day.
7. Notification of Winner The winner will be contacted directly through The Racquets Club’s official Instagram account. If the winner cannot be contacted within 48 hours from the date of notification, they will forfeit the prize, and another winner will be chosen.
Please note: The Racquets Club will never ask for payment or personal banking information. Any accounts contacting you claiming to represent The Racquets Club are not affiliated with us. Do not provide any personal information to such accounts.
8. Publicity By entering, the winner agrees that if they win, they will participate in any reasonable publicity arranged by the Promoter. Entrants agree to their name being used on The Promoter’s social media pages.
9. Content and Intellectual Property Any information submitted by entrants must be personal and relate specifically to the entrant. Entrants warrant that their entry and all information submitted will not infringe the intellectual property, privacy, or any other rights of any third party and will not contain anything defamatory, obscene, indecent, harassing, or threatening. Entrants also warrant they have permission to feature any individuals, content, or material included in their entry.
The Promoter reserves the right to screen, filter, and/or monitor entries for this purpose and to disqualify any entry that does not meet the requirements.
10. Technical Issues The Promoter and its agents will not be responsible for any entries that are not included due to technical failures or other issues, including failures within the Promoter’s control. Proof of submission is not proof of receipt.
11. Disqualification The Promoter reserves the right at its sole discretion to disqualify any person it finds to be tampering with the operation of the promotion or acting in violation of these terms and conditions.
12. Liability The Promoter will not be liable for any loss (including, without limitation, indirect, special, or consequential loss), expense, damage, injury, or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with use of the promotion, except for any liability that cannot be excluded by law.
13. Fraud and Abuse The Promoter accepts no responsibility for any third-party illegal or fraudulent actions that may occur on or through the promotion. However, the Promoter reserves the right to take action against any third party responsible for such fraudulent actions.
14. Website and Platform Issues The Promoter’s Instagram page may contain links to other websites. Please be aware that the Promoter does not control, recommend, or endorse any third-party websites, products, or services linked from its page. The Promoter also does not accept responsibility for any intermittent issues on the Instagram platform or for any other problems that prevent entries from being received.
15. Force Majeure If for any reason any aspect of the promotion is not capable of operating as intended — including but not limited to infection by a computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures, or any cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the competition — the Promoter may, at its sole discretion, cancel, terminate, modify, or suspend the promotion.
16. Severability If any clause of these Terms is deemed unenforceable, it shall be severed, and the remaining Terms shall remain in force.
17. Governing Law These terms and conditions are subject to the laws of Spain and the exclusive jurisdiction of the courts of Spain. The Promoter reserves the right, at its sole discretion, to modify these Terms at any time, and limits its liability in relation to such action to the fullest extent permissible by law.
